On September 23, 2003, the General Rural Flexible zone was approved by the county board for the Town of Ellsworth. Current zoning for the Town of Ellsworth includes: General Rural Flexible, Primary Agriculture, Rural residential 20, industrial, light industrial, and commercial. General Rural Flexible allows 4 houses per 40 acres and up to 8 with town board approval. Primary Agriculture allows 2 houses per 40 acres.

The minimum lot size in the Town of Ellsworth is 2 1/2 acres (adopted June 2006).
